These Terms of Use (the “Terms”) and End User Licence Agreement govern your use of the SomaGiri app. By downloading or using SomaGiri, you agree to these Terms. If you do not agree, please do not use the app.
1. The app
SomaGiri is a meditation, somatic and breathwork app created by Gary Els of the SomaGiri Journey Centre, South Africa (“SomaGiri”, “we”, “us”). It offers guided meditations, breathwork and related content for personal relaxation and wellbeing.
2. Licence to use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use SomaGiri on Apple-branded devices that you own or control, for your own personal, non-commercial use, in accordance with the Apple App Store Terms of Service and the Apple Licensed Application End User Licence Agreement.
3. What you agree not to do
- Copy, redistribute, sell, sublicense, or publicly perform the meditations or other content.
- Reverse engineer, decompile, or attempt to extract the source code, except as permitted by law.
- Use the app in any unlawful way or in any way that interferes with its operation or security.
4. Subscriptions and auto-renewal
Some content requires a paid subscription, purchased through the Apple App Store. Subscriptions are billed to your Apple ID. Subscriptions renew automatically at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription at any time in your Apple ID account settings. Where a free trial is offered, any unused portion is forfeited when you purchase a subscription. Prices may vary by region and are shown in the app before purchase.
5. Not medical or professional advice
SomaGiri is provided for general relaxation and wellbeing and is not a medical device and not a substitute for professional medical, psychological, or mental-health care. The content does not diagnose, treat, cure, or prevent any condition, and nothing in the app should be taken as medical or therapeutic advice. If you have any health concerns, or before beginning any new wellbeing or breathing practice, please consult a qualified healthcare professional. If you are experiencing a crisis or emergency, contact your local emergency services. You use the app at your own discretion and are responsible for practising safely — for example, never use guided audio while driving or operating machinery.
6. Intellectual property
The app, its design, the SomaGiri name and branding, and all meditations, recordings, audio, text, and other content are owned by SomaGiri and Gary Els, or licensed to us, and are protected by intellectual property laws. Except for the limited licence granted above, no rights are transferred to you.
7. User content
Any notes or journal entries you create remain yours and are stored as described in our Privacy Policy. You are responsible for the content you create within the app.
8. Disclaimers
The app is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or available at all times.
9. Limitation of liability
To the fullest extent permitted by law, SomaGiri and Gary Els will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the app. Where liability cannot be excluded, our total liability is limited to the amount you paid for the app or subscription in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Apple
These Terms are between you and SomaGiri, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide support or maintenance. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Termination
We may suspend or end your access if you breach these Terms. You may stop using the app at any time by deleting it. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict-of-laws rules. Subject to any mandatory consumer-protection rights you may have where you live, you agree to the jurisdiction of the courts of South Africa for any dispute relating to these Terms.
